Requirements to Build an ADU in San Diego

If you are thinking about building an ADU in San Diego, you should consider some important factors before starting this project. This is because these properties must comply with neighborhood, county, and city council regulations. Failure to comply with these regulations can result in fines and other penalties for the homeowner or the construction company.

The requirements to build an ADU in San Diego include:

  • Residential Zone: First and foremost, to receive construction authorization, the property must be in an R-1 zone, meaning it must be a single-family residence. Additionally, it is necessary to check if multifamily buildings meet the requirements to add an ADU.
  • Lot Size Compliance: Another requirement for building an ADU in San Diego is that the lot must meet the permitted size. Regulations state that the main property must be at least 4,500 square feet. However, the maximum size of an ADU in many San D is 1,200 square feet, which would allow for up to 2 bedrooms.
  • Parking Conditions: An ADU can be built if the main property has outdoor parking or is within half a mile of public transportation.

Requirements to Build an ADU in Carlsbad

  • Lot Limit: In Carlsbad, there is no minimum lot size requirement.
  • Location Review: In Carlsbad, it is allowed to build an ADU next to an existing single-family house or multifamily building. This allows for up to two ADUs on the property. However, it is necessary to check how many ADUs already exist on the property before constructing another one.
  • ADU Size: The size of the ADU that can be built in Carlsbad depends on the size of the main property, as there is no specific limit. To determine the permitted size, you should check with the city council and compare the size of your property to get the exact measurement. However, the maximum height allowed is 16 feet.

In contrast, the cities of Chula Vista, Coronado, Del Mar, El Cajon, Encinitas, Escondido, Imperial Beach, La Mesa, Lemon Grove, National City, Oceanside, Poway, San Marcos, Santee, Solana Beach, and Vista share guidelines for constructing an ADU. In this case, the difference is that the main property can be of any size to be eligible for building an ADU, with a maximum height of 16 feet.

Additionally, all areas in San Diego County have specific requirements for building an ADU. Detached and attached ADUs must be constructed at least 4 feet away from the rear and side property lines. Converted and Junior ADUs must be situated at a sufficient distance to ensure fire safety.

Costs and Rentals

Another important aspect to consider to comply with ADU regulations is the allowance for renting and selling the property in the cities. For example, cities in California no longer charge an impact fee for ADU construction. However, owners with an ADU larger than 750 square feet must pay a fee proportional to the size in relation to the main property.

Thanks to a new law, ADU owners in California can now sell their ADU as an independent property. Previously, ADUs could only be rented as they were not considered independent from the main property. However, the updated law allows for separate sales at a lower price than the main residence. Nonetheless, regulations must be reviewed in each district, as this is not yet approved throughout San Diego County. Please check restrictions for where you live.

In conclusion, constructing an ADU goes beyond the design or style you want to give the property. The most important step before starting the process is to ensure the main property meets the requirements set by the County Planning and Development Services authorities. Depending on the city where you plan to build, you need to verify that the main residence meets the necessary measurements to begin the project. Additionally, you should consider permit expenses only if they apply in the city.
